Event Policy

Introduction

This Event Policy outlines the terms and conditions under which events are booked and held at The Malibu Retreat ("Property"). By booking an event at our Property, you agree to comply with this policy.

Booking and Reservation

  1. Eligibility: The client booking the event must be at least 18 years of age and must be present during the event.

  2. Booking Process: To book an event, clients must complete a reservation form and submit it along with a non-refundable booking fee of 25% of the total event cost.

  3. Confirmation: Bookings are not confirmed until the booking fee is received and a confirmation email is sent to the client.

Payment Terms

  1. Deposit: A 50% deposit of the total event cost is required at the time of booking confirmation.

  2. Final Payment: The balance of the event cost is due no later than 30 days prior to the event date.

  3. Methods of Payment: Payments can be made via credit card, bank transfer, or check. All payments must be in USD.

Cancellations and Refunds

  1. Cancellation by Client: Cancellations must be made in writing. If a cancellation is made more than 60 days before the event, the deposit will be refunded minus the booking fee. Cancellations made 30 to 60 days before the event will result in a 50% refund of the deposit. Cancellations made less than 30 days before the event will not be eligible for a refund.

  2. Cancellation by Property: In the unlikely event that the Property must cancel a booked event, a full refund will be issued to the client including the booking fee.

Event Day Guidelines

  1. Setup and Takedown: Clients have access to the event space for setup 4 hours prior to the event start time and 2 hours after the event for takedown. Additional time can be arranged for a fee.

  2. Maximum Capacity: The maximum number of guests allowed is determined by the event space selected. Exceeding the maximum capacity may result in additional charges or cancellation of the event.

  3. Noise and Music: All events must comply with local noise ordinances. Outdoor music must be reduced to background levels by 10 PM.

  4. Decorations: Decorations are permitted but cannot cause damage to the Property. Nothing may be nailed, screwed, or adhered to the walls or flooring.

Responsibilities of the Client

  1. Conduct: Clients are responsible for the conduct of their guests. Disorderly behavior may result in early termination of the event without refund.

  2. Damage: Clients are responsible for any damage to the Property or its furnishings caused by the client or their guests during the event. A security deposit may be required, which will be refunded after the event if no damages are incurred.

  3. Insurance: Clients must obtain event liability insurance covering up to $1 million in damages and list The Malibu Retreat as additionally insured.

Liability

  1. Limitation of Liability: The Malibu Retreat will not be responsible for any loss, damage, or injury sustained by the client, guests, or third parties as a result of the misuse of the property by the client or guests.

  2. Indemnification: The client agrees to indemnify and hold harmless The Malibu Retreat and its employees against any claims arising out of or related to the client's event.

Cancellations and Refunds

Miscellaneous

  1. Force Majeure: Neither party will be liable for any failure to perform its obligations if such failure is caused by circumstances beyond reasonable control, including but not limited to acts of God, weather conditions, or government restrictions.

  2. Compliance with Laws: The client is responsible for obtaining all permits necessary for the event and for ensuring that the event complies with all applicable laws and regulations.

Acceptance

By booking an event at The Malibu Retreat, the client acknowledges they have read, understood, and agreed to comply with this Event Policy.
